Moving With a Child: What You Need to Know
In order for a child custody and visitation agreement to be changed or modified, it must be shown that a significant change in circumstances has occurred to cause a request for modification. In child relocation cases, it could be any of the following:
- Relocating for a job
- Relocating due to remarriage
- Relocating due to a change in needs of the child
As in all legal matters affecting children, the courts will consider how the move will impact the child. If the move is not in the best interests of the child, the modification may not be approved. The court will also consider the ability of the noncustodial parent to see the child, the age and health of the child (and parents), and in some cases, the child's wishes.
